By accessing or using Gabify, you confirm that you have read, understood, and agree to these Terms and any other policies referenced herein, including Gabify's Privacy Policy. These Terms constitute a binding agreement between you and Gabify.

Gabify reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms at any time. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any changes.

By using the Platform, you represent and warrant that:

• You are at least 18 years of age or have obtained the necessary consent from a parent or guardian.

• You have the legal capacity to enter into this agreement and comply with these Terms.

• You will use the Platform only for personal, non-commercial purposes unless expressly authorized by Gabify.

Gabify provides Users access to speech therapy tools, resources, and tele-therapy services enabled by Artificial Intelligence. Users agree to use the Platform and its services solely for their intended purpose and in accordance with all applicable laws and regulations.

Unauthorized use of the Platform is strictly prohibited and may result in the termination of your account and legal action. Unauthorized uses include but are not limited to:

• Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the Platform without express written permission from Gabify.

• Using the Platform to transmit any unlawful, harmful, defamatory, or otherwise objectionable material.

• Attempting to interfere with or disrupt the operation of the Platform.

To use certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.

• Maintain the security of your password and accept all risks of unauthorized access to your account.

• Immediately notify Gabify of any unauthorized use of your account or any other breach of security.

• Not create an account for anyone other than yourself without permission or create multiple accounts.

Gabify reserves the right to refuse registration, suspend or terminate your account at any time, without notice, for any reason, including any breach of these Terms.

Gabify offers both free and paid services. All fees are payable in advance and are non-refundable unless expressly stated otherwise. By purchasing any service, you agree to pay all applicable fees and taxes. Failure to pay these fees may result in the suspension or termination of your account.

Gabify reserves the right to change its pricing, payment terms, and billing practices at any time, without prior notice.

Users may be permitted to submit, post, or share content (collectively, "User Content") on the Platform. By submitting User Content, you grant Gabify a worldwide, perpetual, irrevocable, royalty-free, and non-exclusive license to use, reproduce, distribute, display, modify, and otherwise exploit your User Content for any purpose, in any form, and via any media now known or hereafter developed.

You represent and warrant that your User Content does not violate any applicable law, infringe any third-party rights, or contain any defamatory, libelous, obscene, or otherwise unlawful content. Gabify is not responsible for any User Content, and you agree to indemnify Gabify for any claims arising out of or relating to your User Content.

All content and materials on the Platform, including text, graphics, logos, images, and software, are the property of Gabify or its licensors and are protected by copyright, trademark, and other applicable laws. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for personal, non-commercial purposes. Any unauthorized use of the Platform's content may result in legal action.

Gabify provides the Platform on an "as is" and "as available" basis, without any warranties or representations, express or implied. Gabify does not guarantee that the Platform will be error-free, uninterrupted, or secure. Gabify disclaims all liability for any loss, damage, or injury arising from your use of or inability to use the Platform.

To the fullest extent permitted by law, Gabify shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with the Platform or these Terms, even if advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Gabify, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Platform.

• Your breach or alleged breach of these Terms.

• Your violation of any applicable law or regulation.

• Your User Content or any other content you provide to the Platform.

The Platform may contain links to third-party websites or services that are not owned or controlled by Gabify. Gabify has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Gabify shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of any such third-party websites or services.

Gabify reserves the right, in its sole discretion, to terminate or suspend your account or access to the Platform at any time, without notice, for any reason, including without limitation if Gabify believes you have breached these Terms. Upon termination, all rights and licenses granted to you in these Terms will immediately cease, and you must stop using the Platform.

These Terms shall be governed by and construed in accordance with the laws of [India]. Any dispute arising out of or in connection with these Terms shall be resolved exclusively in the courts of New Delhi, India.

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with any policies referenced herein, constitute the entire agreement between you and Gabify regarding your use of the Platform and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written.
